Minors, who possess dual nationality and live outside the EU for a substantial amount of time, may lose their Dutch nationality automatically when their parents fail to renew their Dutch passports on time.
According to Advocate General Paolo Mengozzi in his Opinion of July 12, 2018, Dutch law is incompatible with EU law when it deprives minors of their Dutch nationality because it is harmful to the interests of the child and contrary to its rights as an EU citizen. Even if the child can reapply for Dutch citizenship as an adult.
In contrast, the Advocate General concludes that Dutch law is compatible with EU law if an adult loses Dutch citizenship under the same circumstances.
