Proposals to tighten Aliens Employment Act and highly skilled migrant scheme

Agreements made by the coalition government regarding labour migration have been detailed in a letter dated 11 April 2011 and signed by the Ministers of Social Affairs and Employment and Immigration and Asylum. Although the Aliens Employment Act and the ruling regarding highly skilled migrant labourers does not require structural review, a number of the existing regulations will be tightened.


The granting of Dutch work permits to non EU nationals will continue to be done so on an exceptional basis. Furthermore, the government has stated that people on benefits must accept work made available to them. And, non EU nationals may only be given free access to the Dutch labour market after 5 years of residency, as opposed to 3 years which was the case.

The government wants increased and better control of highly skilled migrants with regards to the salaries they are receiving. Payments overseas will be prevented and the allowances for expenses such as housing may no longer count towards the overall salary. 

Start-up businesses will be better controlled to ensure continuity and stability in order to prevent fraud and fraudulent business constructions.
